1. Who we are

AgilityHub is operated by AGILITY DOG HUB SL, a company incorporated under the laws of Spain, with registered office at Carrer Sant Pere 10, 08392, Sant Andreu de Llavaneres, Spain, tax identification number CIF B56264906, and contact email jboix@agilitydoghub.com ("AgilityHub", "we", "us", or "our").

2. Scope of the Service

AgilityHub is an online educational platform focused on dog agility and related training content. The Service may include, depending on your purchase or subscription:

• recorded training videos and courses;
• digital learning materials and downloadable resources;
• subscriptions giving access to a content library or program areas;
• live or scheduled online sessions, webinars, or events;
• community, comments, user submissions, or other interactive features;
• promotional offers, discount codes, and special access programs.

Unless expressly stated otherwise at the time of purchase, access is granted for personal, non-commercial use only.

3. Eligibility

You may use the Service only if you have legal capacity to enter into a binding contract under applicable law.

If you use the Service on behalf of a company, club, team, or other entity, you represent that you have authority to bind that entity to these Terms.

If you are a consumer, nothing in these Terms limits any mandatory rights you may have under applicable consumer law.

4. Account registration and security

To access certain parts of the Service, you may be required to create an account.

You agree to:

• provide accurate, complete, and current information;
• keep your login credentials confidential;
• be responsible for all activity under your account;
• notify us promptly of any unauthorized access or suspected security breach.

You must not share your account with others unless a specific plan purchased from us expressly permits multi-user access.

We reserve the right to suspend or terminate accounts created using false, misleading, or incomplete information.

5. Orders and contract formation

A contract between you and AgilityHub is formed when we accept your order and confirm it by email, on-screen confirmation, or other durable medium.

We may refuse or cancel an order before acceptance for legitimate reasons, including pricing errors, payment failure, suspected fraud, misuse of promotional codes, or availability or technical issues affecting the Service.

If we cancel an order after payment has been taken and you are not in breach of these Terms, we will refund the amount paid for the cancelled order.

6. Prices, taxes, and payment

Prices are shown in the currency indicated on the website or checkout page.

Unless otherwise stated, prices will be shown inclusive or exclusive of applicable taxes as indicated at checkout. You are responsible for taxes, duties, or charges legally payable in your jurisdiction, except where law requires us to collect and remit them.

Payments are processed through third-party payment service providers. By submitting payment details, you authorize the applicable payment provider and AgilityHub to charge the relevant amount using your selected payment method.

You agree that:

• recurring subscriptions may be charged automatically at the start of each billing period;
• you must keep your payment method valid and up to date;
• failed payments may result in suspension or loss of access.

We may correct genuine typographical or pricing errors at any time. If a material error affects your order, we will inform you and give you the opportunity to confirm the order at the correct price or cancel it.

7. Subscriptions, renewals, and cancellation

Some parts of the Service are offered on a recurring subscription basis.

Unless expressly stated otherwise at checkout, subscriptions renew automatically for the same billing period as originally purchased until cancelled.

You may cancel your subscription at any time through your account settings or by contacting us at jboix@agilitydoghub.com. Cancellation will normally take effect at the end of the current paid billing period, unless otherwise required by law.

Unless we expressly state otherwise:

• cancellation stops future renewals;
• cancellation does not retroactively undo the current billing period;
• access usually continues until the end of the period already paid for.

We may change subscription prices from time to time. Any price change will apply only from the next renewal, after prior notice where required by law.

8. Withdrawal rights and refunds

If you are a consumer, you may have a statutory right to withdraw from a distance contract within the period provided by applicable law.

For consumers in the European Union, distance contracts generally include a 14-day withdrawal right, but this right may not apply, or may be lost, in certain cases involving digital content or digital services where performance begins during the withdrawal period with the consumer's prior express consent and acknowledgement of the loss of the withdrawal right.

8.1 Digital content and immediate access

If your purchase includes immediate access to digital content, a digital service, or subscription content, AgilityHub may ask you at checkout to expressly request immediate performance and acknowledge that you may lose your withdrawal right once performance begins, to the extent permitted by applicable law.

8.2 Cancellation is different from withdrawal

Cancelling a subscription prevents future renewals. It is not the same as exercising a statutory withdrawal right.

8.3 Refund policy

Except where mandatory law requires otherwise, or where we expressly state otherwise:

• payments for subscriptions are non-refundable once the relevant billing period has started;
• one-time purchases of digital content are non-refundable once access, streaming, download, or other performance has begun;
• we do not provide refunds for failure to use the Service, change of mind after access has started, or partial use of a subscription period.

Nothing in this section limits any non-excludable rights you may have if the Service is not supplied, is defective, or does not conform to the contract.

9. Statutory remedies for faulty digital content or digital services

If digital content or digital services supplied by AgilityHub are not in conformity with the contract, consumers may have statutory remedies under applicable law, which may include bringing the content or service into conformity, a price reduction, or termination with a refund, depending on the circumstances.

If you believe purchased content or a subscribed service is faulty, unavailable, or materially different from what was promised, please contact jboix@agilitydoghub.com.

10. Access rights and permitted use

Subject to these Terms and payment of applicable fees, AgilityHub grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, lawful, non-commercial use.

You must not, unless expressly authorized in writing by AgilityHub:

• resell, sublicense, rent, share, or commercially exploit the Service or any content;
• reproduce, distribute, publicly display, publicly perform, broadcast, publish, or make available AgilityHub content to third parties;
• share login credentials or circumvent access limits;
• copy, scrape, harvest, index, data-mine, or systematically extract content or data from the Service;
• modify, adapt, translate, reverse engineer, decompile, or create derivative works from protected elements of the Service, except where prohibited by law;
• remove, alter, or obscure copyright, trademark, or other proprietary notices;
• use the Service in any way that is unlawful, abusive, fraudulent, or harmful.

If you are a club, team, coach, or business and want commercial or group-use rights, you must obtain a separate written agreement from AgilityHub.

11. Intellectual property

The Service, including its design, layout, software, text, graphics, logos, course structures, video content, audio, downloads, images, and all related intellectual property rights, is owned by AgilityHub and/or its licensors and is protected by applicable laws.

No ownership rights are transferred to you. Your purchase or subscription gives you only the limited access rights expressly described in these Terms.

"AgilityHub" and related names, logos, slogans, and branding are our trademarks or used under license. You must not use them without prior written permission.

12. User content, submissions, and feedback

If the Service allows you to submit comments, reviews, photos, videos, testimonials, messages, or other content ("User Content"), you remain responsible for that User Content.

You represent and warrant that:

• you own the necessary rights to submit the User Content;
• the User Content does not infringe third-party rights;
• the User Content is not unlawful, defamatory, abusive, misleading, obscene, or otherwise inappropriate.

By submitting User Content to AgilityHub, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, publish, display, distribute, and use that User Content for operating, improving, promoting, and providing the Service, subject to our Privacy Policy where personal data is involved.

If you send us ideas, suggestions, recommendations, or feedback about the Service, we may use them without restriction and without compensation.

We may remove User Content at our discretion if we believe it breaches these Terms, applicable law, or the rights of others.

13. Educational nature of the Service and no performance guarantee

AgilityHub provides educational and informational content only.

AgilityHub does not guarantee:

• specific training outcomes;
• competition results, placements, titles, or qualifications;
• that a specific method is suitable for every dog, handler, team, surface, venue, or training environment;
• that any content will be uninterrupted, error-free, or available at all times.

Any progress depends on many factors beyond our control, including the dog's health, temperament, training history, physical condition, handling level, equipment, environment, consistency, and safe execution.

14. Safety and responsibility disclaimer

Dog agility and physical training carry inherent risks for dogs and handlers.

You are solely responsible for:

• assessing whether an exercise is appropriate for you and your dog;
• ensuring the training environment, surface, obstacles, and equipment are safe and suitable;
• warming up, cooling down, supervising your dog, and training within appropriate limits;
• obtaining veterinary, medical, or qualified professional advice where appropriate;
• complying with local laws, event rules, and safety standards.

To the maximum extent permitted by law, AgilityHub is not responsible for injury, damage, loss, or adverse outcomes arising from the way you interpret or apply the educational content.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

15. Third-party services and links

The Service may contain integrations with, embedded tools from, or links to third-party websites, payment providers, video hosts, social platforms, or other services.

We do not control and are not responsible for third-party services, their content, availability, accuracy, policies, or acts and omissions. Your use of third-party services is governed by their own terms and policies.

16. Promotions, discount codes, and special offers

From time to time, AgilityHub may offer discount codes, referral offers, early-bird prices, bundled offers, trial access, giveaways, or other promotions.

Unless otherwise stated in the specific promotion:

• promotions cannot be combined;
• promotions are non-transferable and have no cash value;
• promotions may be limited by time, geography, plan, or user eligibility;
• misuse, fraud, or abuse may result in cancellation of the promotion, the order, or the account.

Separate promotion rules may apply and, in the event of conflict, those specific rules will prevail for that promotion.

17. Availability, updates, and changes to the Service

We may modify, update, replace, suspend, or discontinue any part of the Service at any time for operational, legal, technical, or commercial reasons.

This may include changes to content libraries, trainers, modules, features, layouts, access methods, or technical requirements.

Unless expressly stated otherwise, a subscription gives access to the content and features included in your plan during the active subscription period only. It does not create any right to perpetual access to specific content after your subscription ends.

If we permanently discontinue a paid service you have prepaid for and you are not in breach of these Terms, we will provide the remedy required by applicable law and, where appropriate, may offer a pro-rata refund or alternative access.

18. Suspension and termination

We may suspend, restrict, or terminate your access to all or part of the Service immediately if:

• you materially breach these Terms;
• you misuse the Service or our content;
• you engage in fraud, chargeback abuse, or unlawful conduct;
• we are required to do so by law or to protect the Service, our users, or third parties.

You may stop using the Service at any time. If you wish to end a recurring subscription, you must cancel it before the next renewal date.

Upon termination or suspension:

• your license to use the Service ends;
• access to paid content may end immediately or at the end of the paid period, depending on the reason for termination;
• provisions that by their nature should survive will remain in force.

19. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

AgilityHub disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise.

We do not warrant that:

• the Service will be uninterrupted, secure, or error-free;
• defects will always be corrected;
• the Service will be compatible with your device, software, or internet connection;
• the content will meet your personal goals or expectations.

This section applies only to the extent permitted by law. Mandatory consumer rights remain unaffected.

20. Limitation of liability

To the maximum extent permitted by law, AgilityHub shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, savings, goodwill, opportunity, or data.

To the maximum extent permitted by law, AgilityHub's aggregate liability relating to a paid Service shall not exceed the total amount paid by you for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that cannot lawfully be excluded or limited.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless AgilityHub, its directors, officers, employees, contractors, affiliates, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of:

• your misuse of the Service;
• your breach of these Terms;
• your violation of applicable law;
• your infringement of any third-party rights;
• your User Content.

This clause will not apply to consumers where such indemnification would be prohibited or unfair under applicable law.

22. Privacy and cookies

Your use of the Service is also subject to our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect personal data and how cookies and similar technologies are used.

By using the Service, you acknowledge that personal data may be processed in accordance with those policies.

23. Complaints and consumer dispute resolution

If you have a complaint, please contact us first at jboix@agilitydoghub.com and we will try to resolve it in good faith.

If you are a consumer in the EU and we cannot resolve your complaint directly, you may be entitled to seek help from an accredited consumer dispute resolution body or the European Consumer Centre network, depending on your country and the nature of the dispute. The old EU ODR platform is not referenced.

Nothing in these Terms prevents you from using any complaint, mediation, ADR, or judicial route available under applicable law.

24. Governing law and jurisdiction

These Terms are governed by the laws of Spain.

If you are a consumer, this choice of law does not deprive you of mandatory protections in the country where you habitually reside, where such protection applies under private international law.

If you are not a consumer, any dispute arising out of or in connection with these Terms or the Service shall be submitted to the courts of Barcelona, Spain, unless mandatory law requires otherwise.

25. Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we will publish the updated version on this page and may also notify you by email, account notice, or other means where required by law.

Unless otherwise stated, the updated Terms will take effect on the stated effective date. By continuing to use the Service after that date, you agree to the revised Terms.

No change will retroactively affect rights or obligations that arose before the change, unless required by law or expressly accepted by you.

26. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.

27. No waiver

If we do not enforce a provision of these Terms, that will not constitute a waiver of our right to enforce it later.

28. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law, provided this does not reduce mandatory consumer rights.

29. Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any specific terms presented at checkout or for a particular offer, constitute the entire agreement between you and AgilityHub regarding the Service and supersede prior discussions or understandings relating to that subject matter.
